Week 74: November 27 – December 3, 2017

On 27 November 2017, BBM received a Notice from the Senate Electoral Tribunal (SET) wherein it resolved several matters relative to the election protest of Tolentino vs. De Lima.

On 27 November 2017, BBM received a Notice from the Senate Electoral Tribunal (SET), which resolved to require the COMELEC to conduct Decryption and Printing of Ballot Images, Election Returns and Audit Logs of all clustered precincts in the pilot provinces of Francis Tolentino and to notify the SET and the parties of the schedule of Decryption proceeding.

On 29 November 2017, BBM received a Comment from Robredo wherein she questioned the credibility of the witnesses submitted by BBM for his third cause of action (Annulment of votes for the position of Vice President in the Provinces of Basilan, Lanao del Sur and Maguindanao).

On 29 November 2017, BBM received a Notice from the House of Representatives Electoral Tribunal (HRET) informing the parties that the Decryption proceedings for the fifty-eight (58) clustered precincts in Northern Samar relative to the election protest of Abayon vs. Daza will begin on 6 December 2017at 9:00 a.m. at the COMELEC office in Intramuros, Manila.

After 74 weeks (or roughly 522 days), we are still waiting for the PET :

• to issue a Retrieval Order [per undertaking # 7 of 21]

Note that on 29 August 2017, the PET resolved to Partially Grant [BBM’s] Motion for Retrieval only insofar as all [the] precincts in the provinces of Camarines Sur, Iloilo and Negros Oriental are concerned.” [per item “C” of the Resolution]

• to begin the manual recounting of votes for Camarines Sur, Iloilo & Negros Oriental
