Week 69: October 23 – 29, 2017
On 23 October 2017, BBM received a Letter from the COMELEC informing the parties that the Senate Electoral Tribunal [SET] has custody of the ballot boxes and other election documents in twenty-three (23) pilot precincts in Basilan and Maguindanao relative to the election protest of Tolentino vs. De Lima. COMELEC also informed the parties that it would start preparing for the recounting of votes in the election protest of Tan vs. Hataman.
On 23 October 2017, BBM received a Notice from the House of Representatives Election Tribunal [HRET] informing the parties that the Decryption proceedings in three hundred forty-seven (347) protested clustered precincts in Tawi-Tawi relative to the election protest case of Ajihil vs. Sahali will begin on Tuesday, 7 November 2017 at 9:00 a.m. at the COMELEC office in Intramuros, Manila.
On 24 October 2017, BBM received a Manifestation from the COMELEC informing them that it complied with the PET’s Show Cause Order regarding the post-election activities conducted in Bucay, Abra.
On 26 October 2017, BBM received a Notice from the Senate Electoral Tribunal [SET] wherein it granted Robredo’s request for “only one representative at any given time” although “substitution of representatives shall take place during break time” but denied her “request to observe the appreciation proceedings as these deliberations are confidential and privileged” in the election protest of Tolentino vs. De Lima
After 69 weeks (or roughly 487 days), we are still waiting for the PET :
• to issue a Retrieval Order [per undertaking # 7 of 21]
Note that on 29 August 2017, the PET resolved to “Partially Grant [BBM’s] Motion for Retrieval only insofar as all precincts in the provinces of Camarines Sur, Iloilo, and Negros Oriental are concerned.” [per item “C” of the Resolution]
• to begin the manual recounting of votes for Camarines Sur, Iloilo and Negros Oriental [per undertaking # 11 of 21]
• to resolve our Motion for Reconsideration for the technical examination of the signatures appearing in the Election Day Computerized Voters List [EDCVL] as against the signatures appearing on the Voters Registration Record [VRRs] in connection with the annulment of votes in Basilan, Lanao del Sur and Maguindanao.
