Week 61: August 28 - September 3, 2017

On 29 August 2017, BBM received a Letter from the Manila City Treasurer’s Office informing the parties that in the pending election case of Lim vs. Estrada, the PET authorized COMELEC to transfer 948 plastic ballot boxes to Binondo, Manila. The transfer will be conducted from September 1 - 3, 2017 and all the parties in interest have been allowed to obseve the said activity.

On 29 August 2017, BBM filed a Counter-Manifestation wherein he reiterated his reasons for presenting witnesses for his first, second and third cause of action.

BBM also expressed his reservation with regard to including the COMELEC as a party to his case, as suggested by SC Justice Caguioa during the Preliminary Conference held last 11 July 2017. He argued that since an election protest involves a dispute between the defeated candidate and the winning candidate, impleading the COMELEC would be highly unprocedural.

On 31 August 2017, BBM received a Notice from COMELEC informing the parties that it approved the use of the Election Records (ERs) as well as the Voter’s Registration Records (VRRs) for the technical examination of the pilot precincts being contested in the pending election case of Rama vs. Osmena.

After 61 weeks (or roughly 431 days), we are still waiting for the PET :

• to issue a Retrieval Order [per undertaking # 7 of 21]
• to conduct the manual recounting of votes [per undertaking # 11 of 21]
