On 23 November 2016, BBM received a copy of the Notice of the ‘Excerpt from the Minutes of the Regular En Banc Meeting of the Commission on Elections held on November 02, 2016'. In the said meeting, the COMELEC acknowledged receiving BBM’s letter informing them that he would not be sending any representative to the 26 October 2016 stripping activity in Sta. Rosa, Laguna because to do so would be a clear violation of the PPO issued by the PET.
On 24 November 2016, BBM received a copy of Robredo’s Urgent Ex-Parte Motion for Leave to be Allowed to Decrypt the Set Aside Secure Digital Cards and Printing of Audit Logs dated 15 November 2016. Robredo asked the PET to issue an Order allowing the decryption of the SD cards set aside during the stripping activities as well as the printing of the audit log reports. According to Robredo, during the stripping activity in Sta. Rosa, Laguna, it was discovered that there were several SD cards containing data inside the supposedly “unused” VCM machines which the COMELEC wanted to return to Smartmatic.
On 24 November 2016, BBM filed a Manifestation and reiterated his reason(s) for not sending any representative to witness the closure / stripping activities of the COMELEC in Sta. Rosa, Laguna. Per BBM, the stripping activity clearly violated the purpose of the PPO issued by the PET last 12 July 2016.
BBM requested that he be given a copy of the Minutes of the Proceedings and/or Transcript of Stenographic Notes which were taken during the 26 October 2016 and 02 November 2016 closure / stripping activities. BBM also asked that he be given the results of the decryption of the SD cards from the 1,356 VCMs which were found to contain data during the closure / stripping activities of the COMELEC in Sta. Rosa, Laguna.
As of this date, we are waiting for the PET :
• to issue a Retrieval Order [per undertaking # 7 of 21] and
• to issue a Notice of Preliminary Conference [per undertaking # 8 of 21]
