Week 15: October 10 – 16, 2016

On 10 October 2016, BBM received a Notice from Atty. Jose M. Tolentino, COMELEC Executive Director, informing him of a scheduled briefing on 19 October 2016 in the poll body’s warehouse in Sta. Rosa, Laguna “to discuss the protocol to be observed” for the release to Smartmatic of 1,356 units of VCMs “which were not supposedly deployed and / or used during the May 2016 elections”. The said VCMs will be returned to Smartmatic on 26 October 2016 onwards.

In a related development, COMELEC Commissioner Christian Robert Lim likewise sent a letter dated 27 September 2016 to Supreme Court Chief Justice Maria Lourdes Sereno, informing the High Tribunal that the COMELEC had granted Smartmatic’s request to release the 1,356 units of supposedly unused VCMs. Commissioner Christian Robert Lim said that the approval to release the VCMs to Smartmatic was made “after the poll body had decided that the machines are not covered by the PPO issued by the PET.”*

On 13 October 2016, BBM wrote to COMELEC Commissioner Christian Robert Lim informing him that he will be sending representatives to the poll body’s warehouse in Sta. Rosa, Laguna for the scheduled briefing on 19 October 2016. However, BBM stated that this will be without prejudice to his filing of a subsequent Motion with the PET in relation to his Election Protest.*

As of this date, we are waiting for the PET :

• to issue a Retrieval Order [per undertaking # 7 of 21] and
• to issue a Notice of Preliminary Conference [per undertaking # 8 of 21]
