Abogado - SC asks COMELEC, OSG to comment on possible failure of election for BBM-Robredo case

The Supreme Court of the Philippines has recently released a brief on the electoral protest filed by former Senator Bongbong Marcos against Vice President Leni Robredo.

The SC, acting as the Presidential Electoral Tribunal, is seeking the comment of both the Office of the Solicitor General and the Commission on Elections if they can declare failure of elections in some provinces.

In the press release, the SC en banc is checking if its within their constitutional jurisdiction to annul said elections without special elections or declare it as a failure so they can conduct a special one. They also want it assured that they are not infringing upon COMELEC mandate in doing so.

They have given both the OSG and COMELEC
non-extendable 15 days to give their comments. They must also furnish copies to both parties within that time period.

The SC also noted that everyone concurred in this resolution except Justice Edgardo L. Delos Santos and Justice Priscilla J. Baltazar who are both on leave.
